Probate


Probate is the official ‘proving’ of a will. It is the legal process for handing the estate of someone who has died.


Probate must be granted by a Court to confirm that your will is a valid.

  • Probate Court fees – currently £155 plus £1.50 per copy of the grant
  • Swear fees (for swearing/affirming the oath and exhibit £7.00 per Executor
  • Solicitors’ fees – these will depend on the complexity of the will and how much work is required. O’Haras solicitors charge in the region of £995.00 + vat to obtain a Grant of Probate only. If the estate attracts inheritance tax then the fees will rise.


To deal with the administration of the estate (collecting information regarding assets and liabilities, preparing the probate application, collecting the assets, paying the bills and distributing the estate) then an average estate would be charged between one and three per cent of the gross estate.
